Privacy and Electronic Communications (EC Directive) Regulations 2003

The Privacy and Electronic Communications (EC Directive) Regulations 2003 is a law in the United Kingdom that prohibits the sending of unsolicited emails and the transmission of telephone automated recorded messages for direct marketing purposes without prior consent. It is also unlawful to send direct marketing to someone who has not previously agreed to it, unless there is a prior relationship between the parties. Adding someone’s details to a marketing database and offering an opt-out afterwards is also prohibited.

These regulations can be enforced against offending companies or individuals within the European Union. The Information Commissioner’s Office oversees the enforcement of unsolicited emails and investigates complaints about breaches. Violating these regulations is a criminal offense and can result in fines of up to £500,000. Simon Symeou SMP, operating under, is fully committed to complying with this law at all times.
